How to use it

    First establish whether this applies to you. 380.725(a) binds entities that meet subpart G and are eligible for listing on the Training Provider Registry — a carrier that trains its own entry-level drivers is one; a carrier that only hires drivers trained elsewhere is not.

    Collect the behind-the-wheel self-certification from every accepted applicant before training starts, and file it — 380.707(a) is what requires you to obtain it.

    File a copy of each driver-trainee's commercial learner's permit or commercial driver's licence, as applicable.

    Keep instructor qualification documentation for every instructor, plus copies of the CDLs and endorsements held by behind-the-wheel or theory instructors as applicable.

    File the lesson plans for the theory and behind-the-wheel curricula you deliver, and the individual assessment records for each trainee.

    Date every record as generated or received and retain it at least three years from that date; where an instructor CDL has expired or been cancelled, keep the most recent valid one instead.

              No, and this is worth being precise about because it is a common misreading. 380.725(a) states that the documentation and retention requirements of the subpart apply to entities that meet subpart G and are eligible for listing on the Training Provider Registry. It is a training-provider obligation. A carrier that trains its own entry-level drivers is a training provider and does carry it; a carrier that hires a driver trained by a third-party school does not carry it under this section. If you are looking for a carrier-side obligation to hold evidence of a driver's entry-level training, 380.725 is not the citation for it.

              380.725(b) lists them: behind-the-wheel applicant self-certifications obtained under 380.707(a); a copy of each driver-trainee's commercial learner's permit or commercial driver's licence as applicable; instructor qualification documentation plus CDL and endorsement copies for behind-the-wheel or theory instructors as applicable; the lesson plans for the theory and behind-the-wheel range and public road curricula as applicable; and records of individual entry-level driver training assessments as described in 380.715.

              380.725(c) sets a minimum of three years from the date each required record is generated or received. The clock therefore runs per record rather than per trainee, which is why dating each item on receipt matters. There is one standing exception: where a record such as a behind-the-wheel instructor's CDL has expired or been cancelled, the most recent valid CDL should be retained instead. And the section is explicit that it does not affect any other local, State or Federal requirement prescribing a longer period.

              380.715 defines them in two halves. For theory, the provider must use written assessments covering the knowledge objectives in each unit of instruction in the applicable appendices A through E of part 380, and the trainee must receive an overall minimum score of 80 percent. For behind-the-wheel, the instructor must evaluate and document the trainee's proficiency in BTW skills in accordance with the applicable curricula in appendices A through D. Both are per-trainee records.

              Yes for the split between theory and behind-the-wheel — 380.707(c) permits separate providers for those two portions. It does not permit splitting the behind-the-wheel training itself: both the range and public road portions must be delivered by the same training provider. Each provider keeps the records for the portion it delivered.
